Delhi HC issues notice on plea seeking FIR, NIA probe against Harsh Mander, Swara Bhaskar, others

[dropcap]T[/dropcap]HE Delhi High Court today issued notice to the Central Government and the Delhi Police on a petition filed by one 'Lawyers Voice' seeking the lodging of a First Information Report (FIR) and Special Investigating Team (SIT) probe against Congress leaders Sonia Gandhi, Rahul Gandhi, Priyanka Gandhi, Aam Aadmi Party (AAP) MLA Amantullah Khan, Manish Sisodia, AIMIM leader Waris Pathan, Akbaruddin Owaisi, and advocate Mehmood Pracha for alleged inflammatory speeches made by them.

A Division Bench of Chief Justice DN Patel and Justice C Hari Shankar has issued notice.

High Court has also issued a notice in the impleadment application filed by Advocate Sanjiv Kumar in activist Harsh Mander's petition, seeking registration of FIRs against Mander, RJ Sayema, actress Swara Bhasker, and AAP MLA Amanatullah Khan.

Notice has also been issued in the impleadment application filed by the Hindu Sena President for registration of FIR against AIMIM leaders Akbaruddin Owaisi, Asaduddin Owaisi and Waris Pathan for hate speech.

In his plea, Kkumar has asked for an FIR to be filed against Mander under Section 124A (Sedition), Section 295A (Deliberate and malicious acts, intended to outrage reli­gious feelings of any class by insulting its religion or reli­gious beliefs), Section 153 (Wantonly giving provocation with intent to cause riot—if rioting be committed—if not committed), Section 153A (Promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony), Section 504 (Intentional insult with intent to provoke breach of the peace), Section 505 (Statements conducing to public mischief), and Section 506 (criminal intimidation) of the Indian Penal Code.

With regard to Swara Bhasker and others, the plea seeks FIR under Section 295A, Section 153, Section 153A, Section 504, Section 505 and Section 506 IPC is sought against the Swara Bhasker.

Next date of hearing in these petitions has been fixed for April 13, 2020.
