Union government clears transfer of three HC judges swiftly, Delhi HC Bar Association protests against transfer of Justice Gaurang Kanth

This is in sharp contrast to the transfer of three other high court judges earlier in the week on Thursday. The Union government notified two of these transfers after sitting on the collegium’s recommendation for close to eight months. In one case, the recommendation was ten months old. 

TODAY, the President of India cleared the transfer of three judges from their respective parent high courts to other high courts.

The Delhi High Court’s justice Gaurang Kanth has been transferred to the Calcutta High Court even as the Delhi High Court Bar Association (DHCBA) “unanimously resolved” to request its members to abstain from work on July 17 against the Supreme Court Collegium’s recommendation to transfer Justice Kanth out of the Delhi High Court. 

Justice Kanth was appointed as a Delhi High Court judge on May 18 last year. He is slated to retire in 2037.

Justice Manoj Bajaj has been transferred to the Allahabad High Court, while Justice Dinesh Kumar Singh has been moved to the Kerala High Court from the Allahabad High Court. 

Justice Bajaj was appointed as a judge of the Punjab and Haryana High Court on October 29, 2018. He is slated to retire in 2030. 

Justice Singh was appointed as a judge of the Allahabad High Court on September 22, 2019. He will be retiring in 2028.

The collegium, comprising Chief Justice of India D.Y. Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, B.R. Gavai, and Surya Kant, decided to recommend marching orders for the trio on July 13 for “better administration of justice”.

The recommendations were accepted and transfer Orders issued by the Union government at the speed of light.

Justice D. Ramesh was transferred to the Allahabad High Court from the High Court of Andhra Pradesh, which is his parent high court. Justice Lalitha Kanneganti was moved to the Karnataka High Court from the Telangana High Court. The Supreme Court Collegium on November 24, 2022 had recommended their transfer from their respective parent high courts.
