As the court began hearing the petitions on the recognition of same-sex marriage, the Union government raised the plea to hear its preliminary objection that the court cannot create a new socio-legal institution. The court has now decided to hear the issue on a limited canvas, using an incremental approach, to see whether gender-neutral situations can be accommodated within the Special Marriage Act.
