Witnesses seem to be planted, says Delhi HC; grants bail to Delhi riot accused

The Delhi High Court Wednesday granted bail to an accused in the Delhi riots case observing that the witnesses against him seem to have been planted.

Justice Suresh Kumar Kait added that there was no electronic evidence such as CCTV footage or photos to implicate the accused Irshad Ahmed in the case.

"As per the statement of Constable Pawan and Constable Ankit (both are eyewitnesses and were present at the spot), they had identified the petitioner and other co-accused. However, they have not made any complaint on the date of the incident, i.e. 25.02.2020, whereas the FIR was lodged on 28.02.2020. Thus, the said witnesses seem to be planted one", the Judge said.

Justice Kait also said the charge-sheet had already been filed, and the Trial of the case would take substantial time. He, thus, granted bail to the accused subject to his furnishing a personal bond of Rs.25,000/- and with one surety in the like amount to the satisfaction of the Trial Court/Duty Judge.

The Delhi police had opposed the bail plea.

Irshad Ahmad was booked in an FIR registered against people alleged to have used the house of former AAP councilor Tahir Hussain's-the main accused- for attacking the houses of the other community.
