Irretrievable breakdown of marriage judgment: An interview with Indira Jaising, who was amicus curiae in the case

RECENTLY, in a judgment which is expected to have far-reaching consequences, a five-judge Constitution Bench of the Supreme Court comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, A.S. Oka, Vikram Nath and J.K. Maheshwari held that it can, in the exercise of its inherent power under Article 142 of the Constitution, dissolve a marriage that has irretrievably broken down.

In this interview, eminent constitutional lawyer and human rights defender Indira Jaising speaks about the significance and various facets of the judgment.

It must be noted that Jaising, along with fellow senior advocates V. Giri, Dushyant Dave and Meenakshi Arora, were appointed as amici curiae by a division Bench of the court in 2016 while making reference of the matter to the Constitution Bench.
