Law-merick: Collegium recommendations and the spine of the leftovers

[dropcap]W[/dropcap]ith the Collegium’s recommendation to elevate Justice Indira Banerjee who is No.4 on the All India Seniority List of HC judges and Justice Vineet Saran who is at serial no.5, the following 3 judges who are the top 3 in the All India Seniority List will be superceded:

1.Justice D.B.Bhosale, CJ, Allahabad
2.Justice V.K.Tahilramani, ACJ, Bombay
3.Justice N.H. Patil, Bombay

The Collegium has expressly recorded that numbers 4 and 5 are most suitable for the Supreme Court than any other CJ or puisne judge at present.

In other words,the top 3 are not suitable,whatever the reason. When Justice S.P. Kurdukar, then CJ of Punjab ​& Haryana​ was elevated ahead of Justice M.L. Pendse who was higher on the All India Seniority List, he promptly resigned as CJ,Karnataka and came back to Mumbai.

Fali Nariman,in his autobiography, rates Justice Pendse as the best judge in India at that time.

But those days when self-respect mattered are gone.
Do you think any of these superseded judges are likely to resign?
Do they have the spine?
