Delhi High Court judge who had declined bail to Umar Khalid transferred to Rajasthan

The Supreme Court Collegium recommended the transfer of the Delhi High Court judge Justice Rajnish Bhatnagar to the Rajasthan High Court for “better administration of justice”.

ON Wednesday, the Supreme Court Collegium recommended the transfer of the Delhi High Court judge Justice Rajnish Bhatnagar to the Rajasthan High Court for “better administration of justice”.

The collegium, which comprises Chief Justice of India (CJI) D.Y. Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, B.R. Gavai and Surya Kant, also rejected a request from Justice Bhatnagar to continue working at the Delhi High Court.

The collegium resolution states that as per the memorandum of procedure (MoP), it had consulted judges of the Supreme Court who, being conversant with the affairs of the High Court of Delhi, were in a position to offer views on the proposed transfer.

It also consulted the Chief Justices of the High Court of Delhi and the Rajasthan High Court, the resolution clarifies.

Justice Bhatnagar was part of a Bench that declined bail to activist and former Jawaharlal Nehru University (JNU) student Umar Khalid, who is facing prosecution under the Unlawful (Prevention) Activities Act (UAPA), in connection with the Delhi riots of 2020.

The Bench declining the bail also comprised Justice Siddharth Mridul.
