Major reshuffle in judiciary on the cards as collegium recommends the transfer of 23 high court judges

The Supreme Court Collegium has recommended the transfer of judges from eight high courts. Most requests by the judges for reconsideration of the recommendations turned down. 

THE Supreme Court has recommended the transfer of 23 high court judges, mostly from the Allahabad, Telangana and Gujarat high courts.

Four judges from each of the aforementioned states have been recommended for transfers.

The decision to this effect was taken by the Supreme Court collegium comprising Chief Justice of India Dr D.Y. Chandrachud and Justices S.K. Kaul, Sanjiv Khanna, B.R. Gavai and Surya Kant in a meeting held on August 3 and 10.

From Allahabad High Court

A recommendation has been made to transfer Justice Vivek Kumar Singh to the Madras High Court.

Justice Prakash Padia has been recommended for transfer to the Jharkhand High Court. However, Justice Padia had requested that his transfer be reconsidered.

As an alternative, he sought transfer to one among the high courts of Madhya Pradesh, Patna or Uttarakhand.

But the collegium found no merit in his request and turned it down.

Justice Rajendra Kumar-IV has been recommended to be transferred to the Madhya Pradesh High Court. 

His request to stay the transfer for six months has been turned down by the collegium.

Justice S.P. Kesarwani has been recommended for transfer to the Calcutta High Court.

His request to reconsider his transfer has also been rejected by the collegium.

From Gujarat High Court

Justices Alpesh Y. Kogje, Kumari Gita Gopi, Hemant M. Prachchhak and Samir J. Dave have been recommended for transfer to high courts of Allahabad, Madras, Patna and Rajasthan, respectively.

Justice Prachchhak had refused Indian National Congress leader Rahul Gandhi’s plea for stay on his conviction in the 2019 defamation case.

However, the Supreme Court put a stay on the Gujarat High Court’s Order, last week. 

From Punjab & Haryana High Court

The collegium has recommended the transfer of Justices Arvind Singh Sangwan, Avneesh Jhingan, Raj Mohan Singh and Arun Monga to the high courts of Allahabad, Gujarat, Madhya Pradesh and Rajasthan, respectively.

From Calcutta High Court

Justice Bibek Chaudhuri has been recommended for transfer to the Patna High Court. His request to reconsider his transfer was turned down by the collegium. 

Justice Lapita Banerji has been recommended for transfer to the Punjab & Haryana High Court. Her request to reconsider her transfer did not find merit with the collegium.

Justice Shekhar B. Saraf has been recommended for transfer to the Allahabad High Court.

The collegium rejected his request to be transferred to any of the following locations: Delhi, Hyderabad, Bangalore or Chandigarh.

From Telangana High Court

Justice C. Sumalatha has been recommended for transfer to the High Court of Karnataka.

Initially, the collegium recommended her transfer to the Gujarat High Court. However, on a request made by her, the collegium decided to recommend her transfer to the Karnataka High Court.

She had requested for her transfer to the high courts of neighbouring states, i.e., Andhra Pradesh or Karnataka.

Justice M. Sudheer Kumar has been recommended for transfer to the Madras High Court.

Initially, the collegium had recommended his transfer to the Calcutta High Court. But after reconsidering the request of Justice Kumar, the collegium decided to recommend his transfer to the Madras High Court.

Justice Munnuri Laxman has been recommended for transfer to the Rajasthan High Court. His request for transfer to the Karnataka High Court was rejected by the collegium.

Justice G. Anupama Chakravarthy has been recommended for transfer to the Patna High Court. Her request to reconsider the transfer was also rejected by the collegium.

From Andhra Pradesh High Court

Justice Duppala Venkata Ramana has been recommended for transfer to the Madhya Pradesh High Court.

His request for transfer to the Karnataka High Court was rejected by the collegium.

The collegium also recommended transferring Justice C. Manavendranath Roy, to the Gujarat High Court while rejecting his request for transfer to the Telangana High Court instead.

From Patna High Court

Justice Madhuresh Prasad has been recommended for transfer to the Calcutta High Court.

Justice Prasad had conveyed his consent to the proposal for his transfer to the High Court at Calcutta. 

He had, however, requested that the collegium consider the fact that his younger son’s final board examinations are due in February 2024 while making a final decision in the matter, but the collegium found no merit in his request.

From Karnataka High Court

Justice Narendar G. has been recommended for transfer to the High Court of Andhra Pradesh.

Initially, the collegium had recommended his transfer to the Orissa High Court. But on request to transfer him to one of the neighbouring states of Telangana, Tamil Nadu or Andhra Pradesh, the collegium decided to transfer him to Andhra Pradesh.
