Conversion just for the purpose of marriage unacceptable, says Allahabad HC; dismisses couple’s petition

The Allahabad High Court last week dismissed a petition filed by a married couple seeking direction to private respondents not to interfere with their peaceful married life by adopting coercive measures.

Justice Mahesh Chandra Tripathi observed that the petitioner Priyanshi @ Km Shamreen who is Muslim by birth had converted to Hinduism on June 29. The Petitioners solemnized their marriage according to Hindu rites and rituals on July 31.

Justice Tripathi noted that the petitioner married within one month of converting to Hinduism, which revealed that the conversion had taken place only for the purpose of the marriage.

The Judge cited the Court's decision in Noor Jahan Begum @ Anjali Mishra & Anr. v. State of U.P. & Ors. in which it was held that the conversion just for the purpose of marriage was unacceptable.

While dismissing the petition, the Court said it would be open to the petitioners to appear before the concerned Magistrate to record their statements.
